Terms of Service

These Terms of Service (“Terms”) govern your use of Medopsy, the AI-powered oral board examination practice platform available at medopsy.com (the “Service”), operated by Medopsy (“we,” “us”). By creating an account, accepting an invitation from your residency program, or using the Service, you agree to these Terms.
1. What Medopsy is — and is not
Medopsy provides simulated oral board examinations for educational and training purposes only. Every patient, case, and clinical vignette on the Service is fictional.
- The Service is not medical advice and must never be used to guide the care of a real patient. Examiner dialogue, rubrics, and reports are practice material, not clinical guidance.
- Medopsy is not affiliated with, endorsed by, or connected to the American Board of Anesthesiology (ABA) or any certifying body. Scores and readiness assessments are practice estimates and do not predict or guarantee performance on any real examination.
- AI-generated content can contain errors. Scenario content is reviewed before publication, but you should treat any surprising clinical claim with professional skepticism and consult authoritative sources.
2. Accounts and eligibility
The Service is intended for physicians, residents, and residency program staff, and is available only to users 18 years of age or older. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Accounts are personal: do not share logins or take examinations on another person’s behalf.
3. Program subscriptions and seats
Access is typically purchased by a residency program, which receives a number of seats it may assign to its members. Pilot and paid plan terms are shown in the product or agreed separately with the program. Programs are responsible for the accuracy of the rosters they invite.
4. Recordings and exam integrity
Examination sessions are voice-based. Audio of your session and its transcript are recorded and stored so that you and authorized staff of your program (for example, your program director) can review performance. By taking an examination you consent to this recording. Public demo attempts may retain transcripts and generated feedback for Medopsy internal quality review, but public demo audio is not saved. Do not attempt to manipulate, prompt-inject, or otherwise game the AI examiner or grading system; we may invalidate results obtained that way.
5. Acceptable use
- Do not copy, scrape, or redistribute scenario content, rubrics, or examiner material.
- Do not reverse engineer, probe, or disrupt the Service.
- Do not upload unlawful content or use the Service to harass others.
- Do not access another organization’s data or attempt to exceed your authorized role.
6. Intellectual property
The Service, including all scenarios, rubrics, software, and design, is owned by Medopsy or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service for your own training (or, for program staff, to administer training) while your subscription is active. Your performance data remains yours; you grant us the license needed to operate the Service as described in our Privacy Policy.
7. Availability and changes
We aim for high availability but do not guarantee uninterrupted service. We may modify features, scenario libraries, or these Terms; material changes to these Terms will be notified through the Service or by email, and continued use after notice constitutes acceptance.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF CONTENT, OR NON-INFRINGEMENT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDOPSY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNTS PAID FOR THE SERVICE BY YOU OR YOUR PROGRAM IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms. Sections 6, 8, 9, and 11 survive termination.
11. Governing law
Unless a written agreement with your program says otherwise, these Terms are governed by applicable United States law and the laws of the state where Medopsy is organized, without regard to conflict-of-law rules.
